These Terms of Service govern all services and digital products offered by Bas Enterprises LLC, a Florida limited liability company, operating under the trade name The Gap Analysis. The Gap Analysis operates two distinct service arms: (1) corporate AI strategy consulting and gap analysis services, and (2) digital products and personal development content directed toward individual consumers. These terms apply to both arms and all users, clients, and purchasers, as specified herein.
1. SERVICES PROVIDED Corporate Consulting: The Gap Analysis provides AI strategy assessments, gap analysis reports, and strategic consulting services to organizational clients. All services under this arm are advisory in nature. Implementation of any recommended strategy is expressly excluded unless separately contracted in writing. Digital Products & Consumer Content: The Gap Analysis offers digital products, workbooks, toolkits, and personal development content including but not limited to: the 10-Minute Gap Analysis (lead magnet), The "Am I Really?" Toolkit, The Presence Protocol, The Values Discovery Workbook, and future digital products. The Gap Analysis also produces educational and personal development content distributed via email, social media platforms (including Instagram, TikTok, and YouTube), and other digital channels. All digital products are delivered electronically.
2. REPORT DISCLAIMER Corporate Reports: AI Alignment Reports generated through our scorecard are based solely on self-reported data provided by the respondent. All gap estimates, dollar figures, and projections are illustrative benchmarks intended to inform strategic thinking — they are not audited findings, guaranteed outcomes, or financial advice.
Digital Products & Consumer Content: All digital products, frameworks, workbooks, toolkits, and content published by The Gap Analysis — including social media content, email sequences, and downloadable materials — are intended for personal development and informational purposes only. Results are not guaranteed. Content reflects the perspectives, frameworks, and methodologies of The Gap Analysis and does not constitute licensed therapy, counseling, medical advice, or financial advice. The Gap Analysis makes no warranty, express or implied, regarding outcomes resulting from use of any product or content.
3. DIGITAL PRODUCT PURCHASES
All sales of digital products are final. Due to the immediate and irrevocable nature of digital delivery, The Gap Analysis does not offer refunds once a digital product has been accessed or downloaded. By completing a purchase, you acknowledge that you have reviewed product descriptions and understand what you are purchasing. In the event of a technical delivery failure, please contact us at [email protected] within 7 days of purchase and we will work to resolve the issue.
4. NO IMPLEMENTATION LIABILITY
The Gap Analysis provides strategic direction, frameworks, and personal development tools only. For corporate clients, we are not responsible for outcomes resulting from the implementation of any recommended strategy by the client, their team, or any third-party implementer. For individual consumers, we are not responsible for personal decisions made in connection with use of our digital products or content. All clients and consumers assume full responsibility for their own decisions and outcomes.
5. CONFIDENTIALITY All reports, roadmaps, and strategic deliverables produced for organizational clients are confidential and intended solely for the use of the contracting organization. Unauthorized reproduction, distribution, or resale is prohibited. Digital products sold to individual consumers are licensed for personal, non-commercial use only and may not be shared, resold, or redistributed in any form.
6. INTELLECTUAL PROPERTY All templates, frameworks, methodologies, content, deliverable formats, visual identity, branding, social media content, and digital products created by The Gap Analysis remain the intellectual property of Bas Enterprises LLC. This includes all content published across Instagram, TikTok, YouTube, email communications, and any other channels. Client-specific content contained within consulting deliverables is licensed to the contracting client for internal use only. Purchased digital products are licensed to the individual purchaser for personal, non-commercial use only. No content may be reproduced, distributed, modified, or used for commercial purposes without express written permission from Bas Enterprises LLC.
7. EMAIL COMMUNICATIONS & MARKETING
By opting in to any lead magnet, free resource, or email list operated by The Gap Analysis, you consent to receive automated email sequences and ongoing marketing communications. You may unsubscribe at any time using the link provided in any email. The Gap Analysis uses email automation for lead nurturing and product communications. We do not sell or share your personal information with third parties for their marketing purposes.
8. SOCIAL MEDIA & THIRD-PARTY PLATFORMS
Content published by The Gap Analysis on Instagram, TikTok, YouTube, and other third-party platforms is subject to the terms and policies of those respective platforms. The Gap Analysis is not responsible for the policies, practices, or actions of these platforms. Social media content is provided for informational and personal development purposes only and does not constitute professional advice of any kind.
9. PAYMENT TERMS
Corporate Consulting: Consulting engagements require a signed agreement and deposit before work begins. All fees are non-refundable once strategic work has commenced. Retainer agreements renew as specified in the individual client contract.
Digital Products: All digital product purchases are processed at the time of transaction. All sales are final as described in Section 3.
10. LIMITATION OF LIABILITY To the fullest extent permitted by law, The Gap Analysis and Bas Enterprises LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services, digital products, content, or deliverables. For corporate consulting clients, total liability shall not exceed the fees paid for the specific engagement giving rise to the claim. For digital product purchases, total liability shall not exceed the purchase price paid for the specific product giving rise to the claim.
